What power/authority does a mall security guard have over me?
lets say I am being a loud mouth, or rude to a cashier, or do something lewd. I know the security guard can escort me out. Does he have the right to detain me, search me?
Do I have the right to just walk away if he’s lecturing me, does he have the right to use physical force?
None of this actually happened by the way, I’m just curious.
The only reason I can think of for detaining you is if you did something that would warrant holding you for the police. Such as stealing, assault, damage to property, some other law being broken by you or suspicion of such.
So, yes, they can detain you if they suspect you have broken some law. Searching you is variable. By state and by individual circumstance.
I would personally insist on a uniformed police officer be present for the search, if I was not holding stolen merchandise. Helps for the eventual lawsuit against the store for unlawful detainment. If I was holding stolen merchandise, I sure as hell wouldn’t want the real cops around – you might be able to negotiate a settlement with the rent-a-cops, but you are going to jail when they find the stolen stuff if a cop is present.
If I was a minor, I would insist they call my parents and to have them present for the search. They are going to call them anyway, or the police, so you might as well get it over with up front.
Most security people will not use physical force to remove you, but if you don’t leave, they can call the real cops and have you removed in cuffs for trespassing. The lecture is overrated and unnecessary, if they want you to leave, just say whatever, spare me the lecture, follow me out, I’m leaving. Then go directly to the door and leave.
Anyone, including security has a right to protect themselves and others. If you are being physically threatening to the security officer or to people in the mall, they have the right to become reasonably physical with you
